December 7, 2016        Namur Declaration of 5 December 2016: An EU-Values Driven Path to Negotiating and Concluding Economic and Trade Agreements .Author: Diane Desierto

Distinguished scholars in political economy, international economic governance, economics and law, have weighed in on how international economic agreements must be negotiated (or renegotiated).  Paris School of Economics’ Thomas Piketty, Harvard Kennedy School’s Dani Rodrik, the EUI’s Marise Cremona, University of Oxford’s Paul Craig, among a whole corps of global experts, have just signed the landmark Namur Declaration of 5 December 2016.  (For the full list of signatories, see here.) The Namur Declaration sets forth key propositions for any EU negotiation of trade and economic agreements (particularly those forthcoming with the United States), stating that the EU should ensure that there is mandatory: 1) respect for democratic procedures; 2) compliance with socio-economic, sanitary, and environmental legislation; and 3) guaranteed public interests in any dispute resolution mechanism.

20 Febrero 2017 - Post-Truth and International Criminal Tribunals- With all the daily going-ons of our new era of resurgent populist nationalism, it's no wonder that concepts such as 'post-truth' and 'alternative facts' are so very much en vogue, or that Orwell's 1984 and other dystopian classics are once more hitting the best-seller lists. But the sad truth is that there's nothing really new about 'post-truth', except that it is today afflicting developed, democratic societies that until now did not experience the phenomenon, or at least did not experience it in full force.

07 Febrero 2017 -  Panel on Travel Ban & Immigration Orders

by Kristen Boon

Seton Hall Law School (where I am a professor) organized an excellent panel on the travel ban and immigration restrictions last Thursday, Feb 2.    For those who wish to learn more about the legal effects of the executive order, I encourage you to watch it here.

You will see presentations by Professors Lori Nessel, Ed Hartnett and Jonathan Hafetz discussing the immigration orders, their constitutionality, and possible challenges to those orders.  The panel was moderated by Professor Jenny-Brooke Condon.

This is a fast moving issue – please note this panel predated multiple developments and decisions by judges in several jurisdictions over the weekend, which considered the constitutionality of the travel ban.

To stay current, you can access all briefs and decisions at this link, which has been setup by the Civil Rights Litigation Clearinghouse at the University of Michigan Law School.

22 Diciembre 2016 - Space law revisited (1/3): The notion of ‘peaceful uses’ and the Outer Space Treaty

Outer space is becoming an arena for technological shows of force – whether by deployment of spy satellites or testing of weapons. What does international space law have to say on the militarization of space? In this three-post series, Pavle Kilibarda attempts a broader interpretation of the norms, one that would lead to a more pacifist reading of the law. The triad supplements Intercross’ series Why Outer Space Matters, which came out of the October 2016 Inaugural Plenary of the MILAMOS Project in Montreal, Canada.
